Student questioned about alleged rape leaves Western

The student who allegedly raped a woman at the Sigma Nu fraternity house has left Western, President Gary Ransdell said.

The student was going to have a disciplinary hearing with Western officials this week, but decided to leave school on his own, Ransdell said.

The student has not been named and no legal repercussions have been brought against him so far because the case is still being investigated, said Officer Jerry Corbitt of the Bowling Green Police Department.

The exact reasons behind the disciplinary hearing could not be released because of the Family Educational and Privacy Rights Act, said Howard Bailey, the dean of student life.

According to a police department crime report filed Feb. 5, a woman was attending a party on Saturday, Feb. 4 at the Sigma Nu house at 1311 College St. At about 3 a.m. Sunday, she went to bed at the house and had consensual sex with an unnamed person.

She awoke about three hours later and realized she was being raped by someone other than the person with whom she had gone to bed, the report stated.

The police found the student in Keen Hall the same day the initial report was filed and took him in for questioning, according to the police report.

He was interviewed and a Kentucky State Police sexual assault evidence collection kit was conducted on him. His pants, socks and underwear were taken for evidence and he was released, according to the report.

Sigma Nu President Andrew Rash said the student was not a member of the fraternity.

The commonwealth’s attorney could pursue the case if the woman didn’t press charges against the student, said Chris Cohron, first assistant commonwealth’s attorney.

However, the case would be very difficult to prosecute without victim cooperation, Cohron said.
